Terms of Service

These Terms of Service ("Terms") govern your access to and use of nomadicinfluence.com, the Nomadic Influence mobile app, and any related services (together, the "Services"), operated by Nomadic Influence ("Nomadic Influence," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. Who Can Use the Services
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or enter into a collaboration through the Services. By using the Services, you represent that you meet this requirement and that any information you provide is accurate and complete.
2. Creator & Business Accounts
Creators apply to join the Nomadic Influence roster and, once approved, manage their profile and media kit through Pillar. Businesses may browse the roster, post opportunity listings, and register for services like Done-For-You campaigns or Coffee Chats. You're responsible for the accuracy of the information in your profile or listing, and for keeping your login credentials secure.
3. How Collaborations Work
Nomadic Influence provides the marketplace, tools, and, for Done-For-You campaigns, campaign management, that connect creators and businesses. Except where Nomadic Influence is directly managing a Done-For-You campaign, the specific terms of a given collaboration, including deliverables, timelines, and compensation, are agreed between the creator and the business. Nomadic Influence is not a party to that agreement and is not responsible for either side's performance of it.
4. Payments & Fees
Opportunity listing fees, Done-For-You package fees, and any other paid services are billed as described at the time of purchase. Fees are non-refundable except where required by law or expressly stated otherwise. Compensation for individual creator collaborations (such as paid rates, hosted stays, or comped product) is set by the business posting the opportunity and is described in that listing.
5. Content & Licensing
Creators retain ownership of the content they create. When a creator delivers content as part of a collaboration, the scope of the business's right to use that content (for example, on social media, in advertising, or elsewhere) is set out in that specific opportunity listing or agreement. You may not use content from the Services in ways that exceed the license you've been granted.
6. Acceptable Use
You agree not to: misrepresent your identity, audience, or business; use the Services for any unlawful purpose; interfere with the security or operation of the Services; scrape or harvest data from the Services without permission; or post false, misleading, or infringing content.
7. Third-Party Services
The Services integrate with third-party platforms, including Pillar, HubSpot, Google Calendar and Meet, and the Apple App Store and Google Play. Your use of those platforms is subject to their own terms and policies, and Nomadic Influence is not responsible for their performance or availability.
8. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee that any listing, application, or collaboration will result in a booking, sale, or any particular outcome.
9. Limitation of Liability
To the fullest extent permitted by law, Nomadic Influence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services, whether based on warranty, contract, tort, or any other legal theory.
10. Indemnification
You agree to indemnify and hold Nomadic Influence harmless from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or to Nomadic Influence.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the Services after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the state in which Nomadic Influence is registered, without regard to its conflict of law principles.
